IMPORTANT DISCLAIMER: Body Journey provides AI-generated workout suggestions and nutrition analysis for informational purposes only. This is NOT medical, fitness, or nutritional advice. You are solely responsible for your own health and safety. Always consult qualified healthcare and fitness professionals before starting any exercise or nutrition program.
1. Acceptance of Terms
By downloading, installing, or using the Body Journey mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User" or "you") and the individual operator of Body Journey ("we," "us," or "our"). Your use of the App is also subject to our Privacy Policy, which is incorporated by reference into these Terms.
2. Use of the App
Body Journey is a fitness tracking application that allows you to:
- Track your body transformation progress with photos
- Log weight measurements and view trends
- Create and track workout routines
- Receive AI-generated workout suggestions (Pro feature)
- Analyze food photos for nutritional information using AI (Pro feature)
- Sync data with Apple HealthKit or Health Connect (optional)
- Sync completed workouts to Strava (optional)
- Schedule workouts and receive reminders
2.1 Eligibility
You must be at least 13 years old to use this App. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these age requirements.
2.2 Account Registration
Certain features (AI workouts, AI food logging) require creating an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. AI-Generated Content Disclaimers
3.1 AI Workout Disclaimers - READ CAREFULLY
ASSUMPTION OF RISK: AI-generated workout plans are algorithmic suggestions based on the information you provide. They are NOT personalized medical advice, fitness coaching, or professional training programs.
YOU ACKNOWLEDGE AND AGREE THAT:
- AI-generated workouts may NOT be appropriate for your individual fitness level, medical conditions, injuries, or physical limitations
- Exercise carries inherent risks including but not limited to: muscle strain, sprains, fractures, cardiovascular events, exacerbation of pre-existing conditions, and in extreme cases, serious injury or death
- You are SOLELY responsible for assessing whether any AI-generated workout is safe and appropriate for you
- You MUST consult with a qualified physician, physical therapist, or certified fitness professional before starting any exercise program, especially if you:
- Have any pre-existing medical conditions (heart disease, diabetes, high blood pressure, etc.)
- Have any injuries or physical limitations
- Are pregnant or nursing
- Are over age 45 (men) or 55 (women) and beginning exercise
- Are taking any medications that may affect exercise capacity
- Have been sedentary for an extended period
- You MUST stop exercising immediately if you experience: chest pain, severe shortness of breath, dizziness, nausea, excessive fatigue, or any unusual symptoms
- AI cannot account for gym equipment availability, proper form, your fatigue levels, or environmental factors
- You are responsible for learning and using proper exercise form and technique
- You should start with lower weights/intensity than suggested and progress gradually
NO LIABILITY: We are NOT responsible or liable for any injuries, harm, or adverse effects resulting from following AI-generated workout suggestions. You use AI workout features entirely at your own risk.
3.2 AI Nutrition Analysis Disclaimers - READ CAREFULLY
ACCURACY LIMITATIONS: AI-generated nutritional information from food photos is estimated and may be significantly inaccurate. This is NOT professional nutritional advice or dietary guidance.
YOU ACKNOWLEDGE AND AGREE THAT:
- AI calorie and nutrition estimates can be wrong by 20-50% or more due to:
- Inability to determine exact portion sizes from photos
- Inability to identify hidden ingredients, oils, sauces, or preparation methods
- Misidentification of foods or ingredients
- Variability in food composition and brands
- Technical limitations of AI image recognition
- You MUST independently verify all nutritional information before relying on it
- You MUST consult with a registered dietitian or qualified nutritionist for:
- Personalized dietary advice
- Medical nutrition therapy for health conditions
- Weight management plans
- Specific dietary restrictions or allergies
- Relying solely on AI estimates may result in over-consumption or under-consumption of calories and nutrients
- AI cannot detect allergens, contaminants, or food safety issues
- AI cannot provide guidance on appropriate caloric intake for your individual needs
NO LIABILITY: We are NOT responsible or liable for any health consequences, weight management issues, nutritional deficiencies, or other harm resulting from reliance on AI nutrition estimates. You use AI nutrition analysis features entirely at your own risk.
4. Medical Disclaimers
NOT MEDICAL ADVICE: Body Journey and all its features (including AI-generated content) are for informational and tracking purposes only. Nothing in this App constitutes medical advice, diagnosis, or treatment.
CONSULT YOUR DOCTOR: Before beginning any exercise or nutrition program, you MUST consult with your physician or qualified healthcare provider, especially if you have any medical conditions, take medications, or have any health concerns.
EMERGENCY SITUATIONS: If you experience a medical emergency, call emergency services immediately. Do not rely on this App for emergency medical assistance.
HEALTH DATA SYNC: If you enable HealthKit (iOS) or Health Connect (Android) integration, be aware that:
- Body Journey only READS weight data from your Health app and WRITES workout, nutrition, and heart rate data to it
- This write-only model for workouts prevents duplicate entries and improves data accuracy
- Data synchronization may have delays or errors
- You should verify all synced data for accuracy
- We are not responsible for data loss, corruption, or inaccuracies in health app synchronization
5. User Responsibilities
You agree to:
- Use Good Judgment: Exercise common sense and caution when using any features of the App
- Verify Information: Independently verify all AI-generated content before relying on it
- Follow Laws: Comply with all applicable laws and regulations in your use of the App
- Appropriate Use: Use the App only for its intended purpose of personal fitness tracking
- No Harmful Content: Not upload, share, or transmit any harmful, offensive, or illegal content
- Respect Others: Not misuse the App in any way that could harm us or other users
- Secure Your Device: Maintain the security of your device and account credentials
- Accurate Information: Provide accurate information when using AI features for the best results
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
- WE DISCLAIM ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY
- WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, INFORMATION, OR AI-GENERATED SUGGESTIONS
IN NO EVENT SHALL WE BE LIABLE FOR:
- ANY INJURIES, HARM, OR ADVERSE HEALTH EFFECTS resulting from use of the App or following AI-generated workouts or nutrition advice
- ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP
- DAMAGES ARISING FROM ANY USER CONTENT OR THIRD-PARTY CONTENT
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR DATA OR ACCOUNT
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. FOR FREE USERS WHO HAVE NOT PURCHASED A PRO SUBSCRIPTION, THIS AMOUNT IS ZERO (£0). FOR PRO SUBSCRIBERS, THE MAXIMUM LIABILITY IS LIMITED TO YOUR SUBSCRIPTION FEES PAID DURING THAT PERIOD.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIMITATIONS OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.
7. Indemnification
You agree to indemnify, defend, and hold harmless the operator of Body Journey and any contractors or service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any injuries or harm you suffer while using the App or following AI-generated content
- Any content you upload or transmit through the App
8. Intellectual Property
The App and all its content, features, and functionality (including but not limited to design, text, graphics, logos, icons, images, audio clips, and software) are owned by Body Journey and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
8.1 Your Content
You retain ownership of the photos, data, and other content you upload to the App ("Your Content"). However, by using the App, you grant us a limited, non-exclusive license to:
- Store Your Content on your device and in local encrypted storage
- Process food photos through AI services when you request nutrition analysis
- Sync Your Content with health platforms (HealthKit/Health Connect) if you enable this feature
We do NOT claim ownership of Your Content. We do NOT use your progress photos for any purpose other than displaying them to you in the App.
8.2 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Remove any copyright or proprietary notices from the App
- Use the App for any commercial purpose without our prior written consent
9. Subscriptions and In-App Purchases
9.1 Pro Subscription
Body Journey offers a premium subscription ("Pro") with the following features:
- AI-powered workout generation
- AI food photo nutrition analysis
- Unlimited workout plans
Subscription Tiers:
- Monthly: £3.99 per month
- Yearly: £39.99 per year
9.2 Payment and Renewal
- Payment is charged to your Apple App Store or Google Play Store account upon purchase confirmation
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage subscriptions and turn off auto-renewal in your App Store or Play Store account settings
- No refunds will be provided for unused portions of a subscription period, except as required by law
9.3 Cancellation
To cancel your subscription:
- iOS: Settings → [Your Name] → Subscriptions → Body Journey → Cancel Subscription
- Android: Google Play Store → Account → Subscriptions → Body Journey → Cancel Subscription
Cancellation takes effect at the end of your current billing period. You will retain Pro access until that date.
9.4 Refunds
Refunds are handled by Apple or Google, not by us. To request a refund:
- iOS: Visit reportaproblem.apple.com
- Android: Google Play Store → Account → Purchase history → Request refund
9.5 Price Changes
We reserve the right to change subscription prices at any time. Price changes will not affect existing subscribers until their next renewal date. We will provide notice of price changes in accordance with applicable law.
10. Data and Privacy
Your privacy is important to us. Our collection, use, and storage of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.
Key Privacy Points:
- Your photos, weight data, and workouts are stored locally on your device
- Progress photos are NEVER sent to AI services, Strava, or our servers
- Food photos are only processed by AI when you explicitly request analysis
- Strava sync is completely optional and uploads workout data in FIT format (including heart rate and calories if recorded)
- We do NOT collect location data
- Analytics and crash reporting require your consent
11. Termination
11.1 Termination by You
You may stop using the App at any time by:
- Deleting the App from your device
- Canceling your Pro subscription (if applicable)
- Deleting your account from the App settings
11.2 Termination by Us
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Technical or security reasons
11.3 Effect of Termination
Upon termination:
- Your right to use the App will immediately cease
- We may delete your account and data from our systems
- You will lose access to Pro features (if subscribed)
- All provisions that should survive termination will continue to apply (including limitations of liability, indemnification, and dispute resolution)
12. Changes to the App and Terms
12.1 App Updates
We may update, modify, or discontinue any aspect of the App at any time without notice. We may add, change, or remove features or functionality. We are not liable for any modifications or discontinuation of the App.
12.2 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this website
- Updating the "Last Updated" date at the top of this page
- Displaying a notification in the App (for significant changes)
Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App and cancel your subscription (if applicable).
13. Third-Party Services
The App integrates with third-party services including:
- Apple HealthKit and Health app (iOS)
- Health Connect (Android)
- Strava for workout sync (optional)
- Firebase (Google) for analytics, crash reporting, and AI features
- Apple Sign-In and Google Sign-In for authentication
Your use of these third-party services is subject to their own terms of service and privacy policies. We are not responsible for the practices, policies, or actions of third-party services.
13.1 Strava Integration
If you choose to connect your Strava account:
- You authorize Body Journey to upload workout data to your Strava account via Strava's Upload API using FIT (Flexible and Interoperable Data Transfer) file format
- Workout data uploaded to Strava includes: workout name, start/end time, duration, activity type, heart rate data (if recorded during workout), calorie data (active and total calories), and workout summary statistics
- Progress photos, weight data, nutrition data, and detailed exercise information (specific exercises, sets, reps, weights) are NEVER shared with Strava
- The FIT file format provides rich workout data in Strava, including heart rate zones, calorie tracking, and performance charts - the same format used by Garmin, Apple Watch, and other fitness devices
- You can disconnect your Strava account at any time from Settings → Strava
- Your use of Strava is subject to Strava's Terms of Service: strava.com/legal/terms
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any disputes arising from or relating to these Terms or your use of the App shall be resolved through good faith negotiations between you and us. If negotiations fail, disputes shall be resolved in the courts of England and Wales.
14.3 Class Action Waiver
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Body Journey regarding the App and supersede all prior agreements and understandings.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
15.5 No Agency
No agency, partnership, joint venture, or employment relationship is created between you and Body Journey as a result of these Terms or your use of the App.
15.6 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, pandemics, internet or telecommunications failures, or government actions.
15.7 Export Control
You agree to comply with all applicable export and import control laws and regulations in your use of the App.
16. Apple App Store Terms
If you downloaded the App from the Apple App Store, the following additional terms apply to your use of the App:
16.1 Acknowledgement
You acknowledge that these Terms are concluded between you and Nicholas Cullen only, and not with Apple Inc. ("Apple"). Nicholas Cullen, not Apple, is solely responsible for the App and its content. These Terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.
16.2 Scope of License
The license granted to you for the App under these Terms is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
16.3 Maintenance and Support
Nicholas Cullen is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
16.4 Warranty
Nicholas Cullen is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in these Terms. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Nicholas Cullen's sole responsibility.
16.5 Product Claims
You and Nicholas Cullen acknowledge that Nicholas Cullen, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to:
- Product liability claims
- Any claim that the App fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of HealthKit
These Terms do not limit Nicholas Cullen's liability to you beyond what is permitted by applicable law.
16.6 Intellectual Property Rights
You and Nicholas Cullen acknowledge that, in the event of any third party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Nicholas Cullen, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
16.7 Legal Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties

You must comply with applicable third party terms of agreement when using the App. For example:
- When using AI features that require internet connectivity, you must not be in violation of your wireless data service agreement
- When syncing data with HealthKit, you must comply with Apple's HealthKit terms
- When syncing workouts to Strava, you must comply with Strava's Terms of Service
16.10 Third Party Beneficiary
You and Nicholas Cullen acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms as they relate to your use of the App downloaded from the Apple App Store. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
